Letters about
your Debt

Companies you’ve borrowed money from (your creditors) will use letters as the main way to contact you. If you miss payments you’ll find you get lots of them.

If you’re not already, you should always open and read them as soon as they land on your doormat – don’t hide them away. Some letters won’t ask you to take any action, but others are really important, telling you what your creditor plans to do to collect your repayments.

Statements: When everything’s fine you’ll get regular statements showing how much you’ve already paid and how much you still owe. This should be at least once a year.

Reminders: If you miss payments you’ll get reminder letters asking you to get up to date.
You might also get emails, texts and phone calls. They’re usually sympathetic at first… becoming stronger and more threatening if they’re not hearing from you.

Collection letters: After a few reminders, your account may be passed to the collection department. These will feel harsher and sometimes threaten to send debt collectors to your home or take court action.

Default notice: You receive one of these when your creditor is warning you that they will default your account if you don’t settle. Normally they give two weeks to catch up. If you do, your account will return to normal.

Warnings from debt collection agencies: These threaten further action if you don’t pay. Defaulting your account can have serious consequences and damage your credit rating – meaning your missed payments will show up to future creditors.

Solicitors’ letters: If you’ve had a default notice you might hear from their solicitors. You’ll know things are serious but it doesn’t mean you’re definitely going to court! Solicitors don’t have extra powers and must follow the same rules and regulations as your creditors – you can complain if you feel harassed or think you’re being treated unfairly.

Court forms: You’ll get these when your creditors take you to court. These are 100% serious and legal. (But don’t worry – you’re not on your own,
we can still help).




What to do with
the letters

Remember that creditors always send important messages in writing. That’s why it’s vital to read your letters straight away. If a court letter has a deadline to respond, make sure you meet it.

It helps to get organised… file all the letters in date order in one place – putting them in a ring binder can be really helpful and keep them safe. You’ll feel more on top of it, too.

While it’s important to do the best you can to stay on top of things, be aware that some creditors out there may use all sorts of dodgy tactics to mislead you and make you feel really under pressure:

  • Giving you little time to reply
  • Sounding like a solicitor when they’re not!
  • Threatening court action, bankruptcy, enforcement agents, sheriff officers and bailiffs – although they’re probably just saying these might happen, not that they will definitely happen.

Your creditors shouldn’t lie or send you letters that pretend to look like court forms. They also are not allowed to send letters addressed to ‘the occupier’ or tell other people about your debt.

What you can
and can’t do

You can’t stop these letters coming to you – not unless you have a legal debt solution in place. The law dictates that some letters must be sent to you to keep you fully informed and up to date with what’s happening, helping you to stay on top of things.

You can make a complaint if any of these letters feel misleading (in the ways we’ve talked about). You can complain to your creditors, solicitors and debt collection agencies. It’s always best to complain in writing by letter (send it recorded!) or email, so you can keep track of what’s said.

You can take action to sort out your debts with your creditors – or ask us to step in and help you. Even when you feel stuck or trapped, it’s good to remember you always have choices!
